We do not allow Warez, illegal MP3 Sites or IRC Bots.
Note: Adult Sites are only allowed on request, and will ONLY be accepted on a dedicated server. Under no circumstances will adult sites be accepted in our shared hosting environments. To make a request please raise a ticket via our Help
Desk
You may not store more data in your account than your allotted server space.
Your server space and ftp account is for your personal/business use only. You
must not divulge the password to any other person, and you should take reasonable
precautions to ensure that it is not discovered by other people.
Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space and databases.
You may not run server processes (eg. talkers/IRC Bots) from your web space.
We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
When your account is closed, all files (including web pages, etc.) will be deleted.
We reserve the right to cancel your account at any time without notice.
We reserve the right to amend and update these Terms and Conditions at any time without notice.
To protect your privacy we never distribute your name or e-mail address to any third parties.
Users must not participate in any form of un-solicited bulk e-mailing or spam.
By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
Bandwidth
JSWeb operates a fair use policy and therefore offers unrestricted use of bandwidth. Bandwidth usage over and above that allowed in your hosting plan will be subject to an additional charge. Should your bandwidth reach the point where it has an adverse effect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.
(NB. You can help keep your bandwidth down by ensuring that all your images are correctly optimised for the web)
Web Pages
Commercial use of web and ftp space is permitted.
You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
We reserve the right to remove, without prior notice, from your web pages material
deemed inappropriate, including adult content, warez (unlicensed software)
or illegal MP3 web sites on our servers.
Zen Cart (eCommerce Sites)
It is essential that your website is maintained with any security patches and/or upgrades as released by the Zen Cart Development Team unless notified otherwise by us. Your Zencart should always be running the latest stable release as defined by us. Whether you carry out the work yourself, employ a third party* to do it, or have us carry out the work is irrelevant, but it must be done in order to continue having your site hosted at JSWeb. (Also see Shared Hosting Section below).
* Please note that the use of a 3rd party to undertake ANY work on your website, unless approved by JSWeb, OR any work carried out by yourself involving the editing of files or database manipulation which is not accessed via your website admin area, immediately invalidates any guarantee that may have been issued by JSWeb and removes any responsibility on the part of JSWeb for the continued operation of the website after the time of first access by that 3rd party.
Website IP's
JSWeb offers a dedicated IP for each domain that requires an SSL Certificate. If a website does not require a dedicated IP (no SSL) then a shred IP will be provided.
Shared Hosting
a. Our shared hosting environment runs on a set of load balanced servers with a network load balancer determining which server to send each incoming request to. In order for the load balancer to be able to direct traffic to a working server if a server has failed it has a maximum timeout of 30 secs on any HTTP/HTTPS requests. Therefore if you are writing (or have engaged a third party to write) your own software please ensure it returns information to the user's browser at least every 15-20 secs in order to prevent it failing in our environment.
b. You are responsible for maintaining your own site security (again, whether you carry out the work yourself, employ a 3rd party to do it, or have us carry out the work is irrelevant). If a breach of security occurs that affects other users of our servers and can be traced back to your site, you may be held liable for any loss of earnings or damages incurred by them.
NB. We also offer dedicated hosting environments where yours is the only site within that environment - not only does that ensure that no-one else's actions affect you, it also means that you would never be responsible for anything happening to other clients.
Automatic Renewal - Shared Hosting
When you sign up, your JSWEB Hosting account will be enabled with autorenewal, which means that when your renewal date arrives, your hosting plan and domain will be renewed. When it is time for renewal, the credit card you have on file with us will also be charged. If you wish to not have this happen, and you would not like to renew your account, you must cancel 14 days prior to your renewal date. If you have any questions as to when your renewal date is, simply login to your JSWEB Hosting account, or give us a call. If you fail to cancel 14 days prior to renewal, your account will be renewed for a new term, so please be sure to inform us of your cancellation via our helpdesk at https://support.jsweb.co.uk if you do not want to renew. Your account renewal dates are always listed in your Control Panel. If more than 30 days pass from the date on which any invoice for the hosting services is issued to you and we have not received payment in full, we will suspend your account, which means that your data, files and website will become in-active and cannot be accessed.
If in the following 30 days you pay all amounts due, bringing your account up to date, we will take your account out of suspension and the data will be available again immediately.
If, however, 30 days pass from the date on which your account is suspended and you have not made payment in full, JSWEB shall have the right to delete all data you have uploaded to the servers.
Automatic Renewal - Dedicated Hosting
When you sign up or transfer to our Dedicated Hosting service, your JSWEB Hosting account will be enabled with auto renewal, which means that when your renewal date arrives, your hosting plan and domain will be renewed. When it is time for renewal, the credit/debit card you have on file with us will also be charged.
At the expiration of the Initial Contract Term your web hosting will be automatically renewed for successive terms of one year, unless notice of renewal is given by either party no less than ninety days before expiry of the initial term or renewal.
The customer is liable for any unpaid (and unbilled) invoices from the Billing Commencement Date for the remainder of the initial term or renewal term as appropriate unless notice of non-renewal is given as provided above.
Hosting Cancellation and Refunds
If you take out one of JSWeb's yearly hosting packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then JSWeb will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service you have no obligation to continue using our service.
Our 14 day money back guarantee (applicable to annual accounts only) excludes the refund of domain name registration fees, secure server certificate purchases and the purchase of our telephone numbers services.
If the Sign up account offers a FREE service such as SSL (Secure Socket Layer) Certificate then any cancellation will included the cancellation of that item.
JSWeb reserves the right to cancel the service at any time. Customer refund requests are to be sent to accounts@JSWeb.co.uk and will only be processed in the cases of service non-performance where JSWeb is clearly at fault. Refund requests for problems beyond JSWeb's control will be refused.
For example:
Domain transfer failure.
Datacentre (or higher network) failures
Failure of any third party script or program that's not supported by JSWeb.
A customer's lack of experience in dealing with web basics and communication protocols.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold JSWeb harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against JSWeb, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless JSWeb against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with JSWeb's server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from JSWeb's server.
Law and Jurisdiction
This Agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales.
Disclaimer
JSWeb Ltd will not be responsible for any damages your business may suffer,
JSWeb Ltd makes no warranties of any kind, expressed or implied for services
we provide. JSWeb Ltd disclaims any warranty of merchantability or fitness for
a particular purpose. This includes loss of data resulting from delays, non-deliveries,
wrong delivery, viruses and any and all service interruptions caused by JSWeb
Ltd and its employees.
POST PROJECT SUPPORT
We will support you for free during the first 21 days after "go live" - this free support does NOT include any further development, installation of extra modules or additional work, but covers the fixing of any bugs/malfunctions which may arise after the "go live" for which we could reasonably be considered responsible. Questions on managing your ZenCart store will only be answered if they are raised via our Help Desk at http://support.jsweb.co.uk such answers may simply be a link to an existing answer and are usually designed to help you learn how to manage your site without our assistance.
Anything that falls outside the above is considered billable.
JSWeb Ltd reserves the right to revise the above terms and conditions at any time.
